Terms and Conditions of www.profi.lodz.pl

 

§ 1

Overview

1. These Terms and Conditions define the scope of activities carried out by the Service Provider for the benefit of Service Recipients through the www.profi.lodz.pl service, and  in particular:

1) rights and obligations of the Service Provider and Service Recipients related to the provision of Services by electronic means and Additional Services using electronic means of communication through the Website;

2) rules for excluding the Service Provider's liability for the provision of Services by electronic means;

3) rules for the protection of personal data of natural persons using the Services provided electronically.

2. The terms used in the Terms and Conditions shall mean:

1) Service Provider/Personal Data Administrator – the Mayor of the City of Łódź acting through the City of Lodz Office with its registered office at 104 Piotrkowska Street in Łódź, e-mail: lckm@uml.lodz.pl;

2) Service Recipient/User – both the Candidate (a natural person not conducting business activity) and the Employer (a natural person conducting business activity or a legal person who uses the Service provided electronically by the Service Provider);

3) Service Administrator – an employee employed by the Service Provider, dealing with the management of the entire IT system of the Website, responsible for its efficient operation;

4) Provision of the Service by electronic means – the provision of the Service, which takes place by sending and receiving data by means of ICT systems, at the individual request of the Service Recipient, without the simultaneous presence of the parties, and the data is transmitted via public networks within the meaning of the Telecommunications Law Act;

5) Website – a website belonging to the Service Provider, located at the following address: www.profi.lodz.pl within which the Service Provider provides Services to the Service Recipient;

6) Services – all services provided electronically by the Service Provider to Service Recipients, specified in the List of Services of the www.profi.lodz.pl Website  (Appendix 1);

7) Profile – a set of information describing the Service Recipient in detail.

3. The Website is published daily on the Internet in an electronic version at the Internet address https://www.profi.lodz.pl. – owned by the Service Provider and edited by Business Development and International Relations Bureau of the City of Łódź with its registered office in Łódź at Piotrkowska 104a

 

§ 2

Terms of Use

1. The use of all services of the Website is voluntary and free of charge.

2. Registration on the Website is related to the User's consent to:

1) using electronic means of communication (here: the Internet) in order to perform the services of the Website;

2) acceptance of the Terms and Conditions in their entirety, without any exceptions or reservations in this respect;

3) processing of personal data of a person registered by the Service Provider pursuant to Article 6(1)(a) of the General Data Protection Regulation of 27 April 2016 (Regulation (EU) 2016/679 of the European Parliament and of the Council on the free movement of such data and repealing Directive 95/46/EC) in the scope of name, name, e-mail address for the purpose of creating an account and other data provided on their own initiative and included, inter alia, in their CV, cover letter for the purpose of applying for job offers available on the website www.profi.lodz.pl. 

4) making personal data available to Employers registered on the Website pursuant to Article 6(1)(a) of the General Data Protection Regulation of 27 April 2016 (Regulation (EU) 2016/679 of the European Parliament and of the Council on the free movement of such data and repealing Directive 95/46/EC in the scope of: name, surname, e-mail address, . and other data provided on your own initiative and contained, inter alia, in your CV, cover letter

 

3. Registration on the website can be done by:

1) Employers who meet the following criteria at the same time:

a) have their registered office, branch or branch office in Łódź or in the Łódź Voivodeship;

b) offer jobs that will take place in Łódź or in the Łódź Voivodeship.

and

2) Candidates, understood as people interested in working in companies registered on the website.

4. The full range of Services provided by the Website is available to the Service Recipient only after registration and setting up a Profile on the Website.

5. The process of registration and creation of the Profile takes place after the Service Recipient provides the required data and consent to their processing and in the case of the Candidate it takes place automatically, and in the case of the Employer - after prior approval by the Administrator.

6. Each Service Recipient may unregister from the database and resign from using the Website. Upon resignation, understood as the deletion of the account from the Website, all personal data is immediately deleted from the database.

7. Accounts of Users - Candidates who have not used the services of the Website for a period of 12 months, i.e. have not logged in during this period, will be automatically deleted from the Website, and with them all personal data contained in the accounts will be removed from the Website's database. 14 days prior to the date of account deletion, such a Candidate will receive a systeme-mail with an appropriate notification of the noted inactivity on the Website.

8. The Service Provider shall not be liable for improper performance of the Services in the event that the Service Recipient makes available to third parties the login and password established by the Service Recipient allowing access to the resources of the Website.

9. The Service Provider reserves the right to block or delete the Users' account, thus preventing or limiting access to individual or all of the Services and resources of the Website, if the Service Recipient violates the Terms and Conditions, generally applicable laws, rules of social coexistence or acts to the detriment of other Service Recipients or acts to the detriment of the Service Provider or third parties.

 

§ 3

Terms and Conditions for the Provision of Services by the Service Provider

1. In order to use the Website Services, it is necessary to meet the technical requirements of cooperation with the ICT system, and in particular it is necessary to:

1) connection to the Internet;

2) having a web browser installed, at least: Internet Explorer (8.0 or later) or equivalent browsers: Mozilla Firefox, Google Chrome, Safari. Your browser should accept cookies.

2. All costs related to the connection via the Internet and the preparation and configuration of access devices shall be borne by the Service Recipient.

3. All Website Services may be changed in terms of their content and scope, added or subtracted, as well as temporarily suspended, or access to them may be limited, at the discretion of the Service Provider, without the possibility of objecting in this regard.

4. The Service Provider reserves the right to moderate the content posted on the Website by the Service Recipients and refuse to provide the services offered by the Website without giving a reason, if the content posted by the Users violates the generally applicable laws, the provisions of the Terms and Conditions or the principles of social coexistence, however, the Service Provider is not responsible for the content of advertisements, their truthfulness, timeliness, reliability and existence of the Service Recipient.

 

§ 4

Final provisions

1. All provisions of the Terms and Conditions may be unilaterally changed by the Service Provider at any time, without giving reasons. Changes will be published on an ongoing basis in the form of a consolidated text of the Terms and Conditions on the Website. If the Service Recipient does not accept the changes to the Terms and Conditions, the Service Recipient should refrain from logging in to the Website and immediately notify the Service Provider of such a decision.

2. The Service Provider is not responsible, as far as the applicable law allows, for the content transmitted and published on the Website.

3. The Service Provider shall make every effort to ensure that the Website and all Services made available through it operate continuously without any interruptions, however, it shall not be liable for any disruptions caused by force majeure or unlawful interference of Service Recipients or third parties.

4. The Service Provider reserves the right to temporarily, completely or partially disable the Website in order to improve it, add services or carry out maintenance, without prior notice to the Service Recipients.

5. The Service Provider shall not be liable for the loss of the Website data stored in the Service Provider's computer systems, caused by equipment failure, dysfunction of the Internet, loss as a result of third parties or force majeure and fortuitous events.

6. It is forbidden to copy, duplicate or otherwise use information, data or other content of the Website in whole or in part without the Service Provider's written consent, except for the cases of permitted use resulting from the Act on Copyright and Related Rights (Journal of Laws of 2006, No. 90, item 631, as amended).

7. The Service Provider reserves the right to assign in part or in whole all its rights and obligations related to the Website, without the consent and possibility of expressing any objections by the Service Recipients.

 

Appendix 1

List of www.profi.lodz.pl services 

1. Employer:

1) Publication of the employer's profile – thanks to this service, the employer has the opportunity to present their company, basic contact details, scope of activity, achievements and professional prospects. The employer should include the company's logo in the profile. Any change made to the employer's profile before publication must be approved by the Website Administrator.

2) Job Posting – This service allows registered employers to post job offers.  In order for the offer to be published, the employer must create a profile. Posted offers can be freely edited, archived or deleted.

3) Reaching out to the best job candidates from among the candidates registered on the website who have applied for a given job offer.

 

2. The candidate shall:

1) Registration of an account by the Candidate – thanks to this service, the Candidate has the opportunity to create his/her profile with the provision of basic personal data and information on, among others: skills and professional experience gained, as well as recruitment for selected offers.

2) Searching for job offers and browsing employer profiles - thanks to the job search engine, you can choose a job related to the industry or department of the company that interests the Candidate. On the other hand, basic information about potential candidates is provided by a database of profiles posted by employers. 

 

3. Information sections:

1) Employer - this is a section devoted to a wide range of work topics. This section will be particularly useful for employers who are just preparing to hire foreigners. Here they will find examples of documents: how to complete a profile, how to add an advertisement.  There is also a list of all employer profiles registered on the website.

2) Candidate - here you can find application documents, materials that make it easier to write a proper cover letter, CV, as well as thorough preparation for the interview.
